{"id":3796,"date":"2017-07-31T17:10:42","date_gmt":"2017-07-31T22:10:42","guid":{"rendered":"http:\/\/blog.zoha-islands.com\/?p=3796"},"modified":"2017-07-31T17:10:42","modified_gmt":"2017-07-31T22:10:42","slug":"linden-lab-tos-updates-effective-july-21st-2017","status":"publish","type":"post","link":"https:\/\/zoha-islands.com\/blog\/linden-lab-tos-updates-effective-july-21st-2017\/","title":{"rendered":"Linden Lab TOS Updates Effective July 21st &#8211; 2017"},"content":{"rendered":"<p><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.gyazo.com\/03aa2b5b9ca2fceee2e34c6a147443c8.png\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>On Tuesday, July 11th, Linden Lab issued an updated Terms of Service, which is due to come into effect on July 31st, 2017. As is the Lab\u2019s usual practice, anyone logging-in to one of the Lab\u2019s services for the first time after the new Terms have come into force will be required to accept them. As such, a read through is advisable beforehand.<\/p>\n<p>The\u00a0<a href=\"https:\/\/community.secondlife.com\/blogs\/entry\/2205-some-updates-to-the-terms-of-service\/\" target=\"_blank\" rel=\"noopener\">summary<\/a>\u00a0of the changes indicate them to be:<\/p>\n<ul>\n<li>A restructuring of the Terms to include terms and conditions that apply to all Linden Lab products, with separate product-specific references (such as Linden Dollar and LindeX for SL) now contained within product-specific policies. The new Second Life Terms and Conditions contains all the Second Life-specific references that were previously in the Terms of Service.<\/li>\n<li>Reference to the Lab\u2019s wholly owned subsidiaries, Tilia Inc. and Tilia Branch UK Ltd., have been added. These companies will be handling payment services on our behalf under certain circumstances. I first wrote (albeit somewhat speculatively) about Tilia Inc in\u00a0<a href=\"https:\/\/modemworld.me\/2015\/11\/04\/linden-lab-and-tilia-inc-speculations-on-the-labs-new-subsidiary\/\">November 2015<\/a>.<\/li>\n<li>Minor text revisions to clarify that Linden Lab has discretion to undertake certain account actions.<\/li>\n<li>An updated the arbitration provision in accordance with applicable law.<\/li>\n<\/ul>\n<p>In addition to the updated ToS there is a new\u00a0<a href=\"http:\/\/www.lindenlab.com\/legal\/intellectual-property-infringement-notification-policy\" target=\"_blank\" rel=\"noopener\">Intellectual Property Infringement Notification Policy<\/a>\u00a0and a new\u00a0<a href=\"https:\/\/www.lindenlab.com\/legal\/content-guidelines\" target=\"_blank\" rel=\"noopener\">Content Guidelines<\/a>\u00a0document; both of which also take effect from July 31st.<\/p>\n<p>The first of these bullet points sees the most extensive changes to the ToS, with the removal off sections formerly specific to SL, and the removal of references related to the Second Life (e.g. \u201cinworld\u201d) to more generic terms. These are all clearly part-and-parcel of adopting the ToS to encompass Sansar, and some of the amendments make for interesting reading \u2013 such as the definition of terms.<\/p>\n<p>While the blog post refers to \u201cthe Second Life Terms and Conditions\u201d, there is no actual link to such a document at present. There is a link to the Community Standards \u2013 which are still specific to Second Life. However, it is unclear if this is what is meant by \u201cthe Second Life Terms and Conditions\u201d \u2013 and if so, they have not as yet been updated to reflect elements of the ToS specific to SL \u2013 such as the operation of \u201cbots\u201d or to Skill Gaming \/ for profit games of chance, Linden Dollars, the LindeX, etc. Nor are the ancillary policies to Second Life listed (e.g. the Machinima policy, Mainland Policy, etc.).<\/p>\n<p>Excluding the changes specific to Second Life (i.e. removal of references and clauses). The most extensive changes to the ToS can be found in the following sections:<\/p>\n<ul>\n<li>1.1 \u2013 updates to defined terms<\/li>\n<li>2.2 \u2013 licences granted, specifically the section on \u201cLinden Content\u201d<\/li>\n<li>3 Eligibility To Use the Service<\/li>\n<li>4.3 \u2013 payment service providers (including Tilia Branch in the UK)<\/li>\n<li>7 \u2013 Infringement Notifications \u2013 now dealt with via the\u00a0<a href=\"http:\/\/www.lindenlab.com\/legal\/intellectual-property-infringement-notification-policy\" target=\"_blank\" rel=\"noopener\">Intellectual Property Infringement Notification Policy<\/a><\/li>\n<li>9.6 \u2013 Unsolicited Ideas and Materials Prohibited; No Confidential or Special Relationship with Linden Lab<\/li>\n<li>10.2 \u2013 Exceptions to Requirement to Arbitrate (dispute resolution).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; On Tuesday, July 11th, Linden Lab issued an updated Terms of Service, which is due to come into effect on July 31st, 2017.
